Analisis Hukum Pemutusan Hubungan Kerja (PHK) pada Masa Pandemi COVID-19 Berdasarkan Undang-Undang Cipta Kerja Nomor 6 Tahun 2023

This study aims to analyze the legal protection for workers who experienced layoffs due to the COVID-19 pandemic and to evaluate its impact on the employment sector in Indonesia. Using a normative legal approach, the findings indicate that the COVID-19 pandemic triggered a wave of mass layoffs, significantly affecting workers' welfare.Although Law Number 6 of 2023 regulates labor rights, its implementation faces challenges, such as companies' financial difficulties and weak enforcement. Government social assistance programs, such as Job Loss Insurance (JKP), wage subsidies, and Direct Cash Assistance (BLT), have provided support for affected workers. However, unequal distribution and limited protection for informal workers remain significant challenges.Therefore, legal reform, strengthened labor supervision, and improved effectiveness of social assistance programs are necessary to ensure the protection of workers' rights amid the changing dynamics of the labor market.
AbstrakPenelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pekerja yang mengalami PHK akibat pandemi COVID-19 serta mengevaluasi dampaknya terhadap sektor ketenagakerjaan di Indonesia. Menggunakan pendekatan hukum normatif, hasil penelitian menunjukkan bahwa pandemi COVID-19 menyebabkan gelombang PHK massal yang berdampak signifikan pada kesejahteraan pekerja.Meskipun Undang-Undang Nomor 6 Tahun 2023 telah mengatur hak-hak tenaga kerja, implementasinya menghadapi kendala berupa kesulitan finansial perusahaan dan lemahnya pengawasan. Program bantuan sosial pemerintah, seperti Jaminan Kehilangan Pekerjaan (JKP), subsidi upah, dan Bantuan Langsung Tunai (BLT), memberikan bantuan bagi pekerja terdampak. Namun, distribusi yang tidak merata dan perlindungan yang terbatas bagi pekerja informal masih menjadi tantangan.Oleh karena itu, diperlukan reformasi hukum, penguatan pengawasan ketenagakerjaan, serta peningkatan efektivitas program bantuan sosial untuk memastikan perlindungan hak-hak pekerja di tengah perubahan dinamika pasar kerja.
