Tinjauan Yuridis Terhadap Perubahan Identitas di Pengadilan Negeri Sengkang

Abstract

The purpose of this study is to find out the process carried out by the applicant if he wants to apply for a change of identity at the District Court and to find out the factors that affect a person to apply for a change of identity at the District Court. This research is included in the category of empirical legal research, where this research is carried out by means of observation and direct interviews with the research object, which is supported by legal sources and utilizes prescriptive analysis methods. The results of this study show that the process of submitting an application for a change of identity at the District Court is a hearing process attended by the applicant whose hearing issues a court determination which is used as the basis by an applicant to change his or her identity at the Population and Civil Registration Office where the applicant resides or other files that he or she wants to change. Factors that affect a person applying for a change of identity are due to health, providing wrong data, typosing by officers and changing religions. The recommendation given by the author is that it is hoped that in the process of submitting an application for a change of identity, it will not be difficult for the applicant both in the process of registering the application and in the trial process, so that people who want to apply for a change of identity will not become difficult and cause the public not to make adjustments to population data.

Penelitian ini memiliki tujuan guna mengetahui proses yang dilakukan pemohon apabila ingin mengajukan perubahan identitas di Pengadilan Negeri dan untuk mengetahui faktor yang memengaruhi seseorang mengajukan suatu permohonan perubahan identitas di Pengadilan Negeri. Penelitian ini termasuk pada kategori penelitian hukum empiris, dimana penelitian ini dilakukan dengan cara observasi dan wawancara langsung dengan obyek penelitian, yang didukung oleh sumber-sumbber hukum serta memanfaatkan metode analisis preskriptif. Hasil penelitian ini memperlihatkan proses pengajuan permohonan perubahan identitas pada Pengadilan Negeri ini ada proses sidang di hadiri pemohon yang sidang tersebut menerbitkan suatu penetapan pengadilan yang di jadikan dasar oleh seorang pemohon untuk merubah identitas kependudukannya di Dinas kependudukan dan pencatatan sipil tempat pemohon bertempat tinggal atau berkas lain yang yang ingin di ubah. Faktor yang memengaruhi seseorang mengajukan perubahan identitas adalah karena kesehatan, salah memberi data, salah ketik oleh petugas dan pindah agama. Rekomendasi yang di berikan penulis yaitu di harapkan agar dalam proses pengajuan permohonan perubahan identitas ini tidak menyulitkan pihak pemohon baik dalam proses pendaftaran permohonannya maupun proses sidang, agar masyarakat yang ingin mengajukan permohonan perubahan identitas tidak menjadi kesulitan dan menyebabkan bagi masyarakat untuk tidak melakukan penyesuaian data kependudukan.
