Aman di Layar, Rawan di Jalan: Kritik Penanganan Pelecehan Seksual Transportasi Online

Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis efektivitas penanganan tindak pidana pelecehan seksual oleh aparat penegak hukum terhadap kasus yang terjadi di transportasi online di Kota Makassar, serta mengidentifikasi faktor-faktor yang mempengaruhi efektivitas penanganan tindak pidana tersebut.
Penelitian ini menggunakan metode penelitian hukum empiris dengan pendekatan sosiologis. Lokasi penelitian dilakukan di Kota Makassar dengan pengumpulan data melalui wawancara terhadap aparat kepolisian Unit Perlindungan Perempuan dan Anak (PPA), lembaga bantuan hukum, serta pihak terkait lainnya, yang didukung oleh data sekunder berupa peraturan perundang-undangan dan dokumen resmi. Data dianalisis secara kualitatif.
Hasil penelitian menunjukkan bahwa penanganan tindak pidana pelecehan seksual di transportasi online secara prosedural telah dilaksanakan sesuai dengan ketentuan hukum acara pidana, namun secara substantif belum berjalan optimal. Hal ini dipengaruhi oleh rendahnya tingkat pelaporan, kesulitan pembuktian akibat minimnya saksi dan alat bukti, lamanya proses penanganan, serta faktor psikologis korban seperti rasa takut, malu, dan khawatir yang mempengaruhi keberlanjutan perkara. Oleh karena itu, diperlukan penguatan perlindungan korban serta peningkatan efektivitas penanganan perkara melalui kerja sama antar pihak terkait.
Berdasarkan temuan tersebut, ini merekomendasikan penguatan perlindungan korban, peninggkatan kapasitas aparat penegak hukum, serta optimalisasi kerja sama dengan perusahaan transportasi online. Penelitian ini di harapkan dapat memperkaya kajian efektivitas penegakan hukum dalam konteks tindak pidana pelecehan seksual berbasis layanan digital (transportasi online)
Abstract: This study aims to determine and analyze the effectiveness of law enforcement officials' handling of sexual harassment cases in online transportation in Makassar City, as well as to identify factors influencing their effectiveness.
This study employed an empirical legal research method with a sociological approach. The research location was Makassar City, with data collected through interviews with police officers from the Women and Children Protection Unit (PPA), legal aid institutions, and other relevant parties. This data was supported by secondary data in the form of laws and official documents. The data were analyzed qualitatively.
The results indicate that while the procedural handling of sexual harassment in online transportation has been carried out in accordance with the provisions of criminal procedure law, substantively, it has not been optimal. This is influenced by low reporting rates, difficulties in establishing proof due to a lack of witnesses and evidence, lengthy processing times, and psychological factors such as fear, shame, and anxiety among victims, which influence the progress of the case. Therefore, strengthening victim protection and increasing the effectiveness of case handling through collaboration between relevant parties is necessary.
Based on these findings, this study recommends strengthening victim protection, increasing the capacity of law enforcement officers, and optimizing collaboration with online transportation companies. This research is expected to enrich studies on the effectiveness of law enforcement in the context of digital service-based sexual harassment crimes (online transportation).
